Terms and Conditions

1. Introduction
These Terms and Conditions govern the use of the website https://lumessentials.skin/ (the "Site") operated by Lumessentials ("we," "us," or "our") and the purchase of cosmetic products through the Site. By placing an order, you ("you" or "the Customer") confirm that you have read, understood, and agree to be bound by these Terms.

3. Products
Our products are cosmetic products as defined by Regulation (EC) No 1223/2009. All product descriptions, images, and information on the Site are provided for informational purposes. While we strive for accuracy, slight variations in colour or packaging may occur. We reserve the right to discontinue any product at any time.
4. Prices and payment
All prices are listed in EUR and include VAT at the applicable rate.
Prices do not include shipping costs, which will be clearly displayed at checkout before you confirm your order.
We accept the following payment methods: Credit/Debit Card, ApplePay.
Your payment is processed securely, and we do not store your full payment card details.
5. Ordering and conclusion of contract
By placing an order on the Site, the Customer warrants that they are of legal age, possessing full legal capacity to place orders.
Placing an item in your cart does not constitute an order or reserve the product.
An order is an offer by you to buy our products. A legally binding contract between us is only formed when we send you an Order confirmation email. We reserve the right to refuse or cancel any order before this confirmation (e.g., for stock unavailability, pricing errors, or suspected fraud).
Lumessentials will issue an invoice for the purchased Products once your order is accepted, sending it by email to the Customer. No changes to the data will be possible after the invoice is issued.
6. Delivery
Delivery times are estimates and are not guaranteed.
Delivery costs and options (e.g., standard, tracked) will be specified at checkout.
The risk of loss or damage to the products passes to you upon delivery to the address you specified.
For deliveries outside the European Union, you are responsible for any import duties or taxes that may be levied by your country, as the goods are shipped from Italy.
7. Right of withdrawal
As a consumer in the European Union, you have the legal right to withdraw from the contract within 14 days without giving any reason.
Withdrawal period: The withdrawal period expires 14 days after the day you (or a nominee you designate) physically receive the goods.
Exercise of right: To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g., a letter sent by post or email to our contact details in Section 2). You may use the model withdrawal form found in Annex I of the Consumer Rights Directive, but it is not obligatory.
Effects of withdrawal: If you withdraw, we will refund all payments received from you, including the standard delivery cost (but not any additional cost if you chose a more expensive delivery method), without undue delay and within 14 days of us receiving the returned goods. We may withhold the refund until we have received the goods back.
Return of goods: You must send back the goods without undue delay and in any event not later than 14 days from the day you communicated your withdrawal. You are responsible for the direct cost of returning the goods. Goods must be returned in their original, unused, and resalable condition, with packaging.
8. Returns of faulty goods
This right of withdrawal is separate from your legal rights if goods are faulty or not as described. If you receive a faulty product, please contact us immediately at hello@lumessentials.skin. We will comply with all applicable statutory warranty rights.
9. Liability
Nothing in these Terms limits or excludes our liability where that would be contrary to applicable law, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation. Your statutory rights as a consumer are not affected. To the fullest extent permitted by law, we are not liable for losses that are not a foreseeable result of our breach, for indirect or consequential losses, or for any business losses. Subject to the foregoing, our total liability arising out of or in connection with these Terms and your order is limited to the total price you paid for the products.
10. Data protection
We process your personal data in accordance with our Privacy Policy, which is compliant with the EU General Data Protection Regulation (GDPR). Our Privacy Policy explains what data we collect, why we collect it, and your rights regarding your data.
11. Cosmetic product safety information
Our products comply with the safety requirements of Regulation (EC) No 1223/2009.
A Product Information File (PIF) is available for each product and can be provided to competent authorities upon request.
For safety information, a full list of ingredients (INCI), and usage instructions, please refer to the product packaging or its listing on our Site.
12. Complaints and Alternative Dispute Resolution (ADR)
We aim to resolve any complaints amicably. Please contact us first at hello@lumessentials.skin.
The European Commission provides an Online Dispute Resolution (ODR) platform for consumers and traders to resolve disputes out-of-court. You can access it here: https://ec.europa.eu/consumers/odr/. We are not obliged and do not currently commit to use an alternative dispute resolution entity to resolve disputes with consumers.
13. Governing law and jurisdiction
These Terms and any non-contractual obligations arising from them are governed by the law of the Republic of Italy. For consumers, this does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence. Disputes shall be submitted to the jurisdiction of the courts of your place of residence or the courts of Italy.
14. Force Majeure
Lumessentials will not be liable for any failure or delay caused by events that are beyond its control. Force Majeure Events means any act, event or incident beyond all control, including but not limited to: natural disasters, terrorist acts, strikes, blackouts; unforeseeable or unavoidable events that cause delivery delays or make deliveries impossible.
15. Intellectual property right
All content on the Site, including all pages and Product pages, is owned by Lumessentials and is protected by copyright and other intellectual property laws. Any use, even partial, of the same is forbidden without prior written authorization from Lumessentials, in favor of which are reserved, exclusively, all the related rights.
We do not claim ownership of any content you may submit or post on the Site. Such content remains yours, but you grant Lumessentials a non-exclusive, royalty-free licence to use, reproduce, and display it for the purpose of operating the Site and our services.
Any use of the contents and materials of the Site that is intended to train artificial intelligence (AI) systems, as well as the use of automated data scraping means, is strictly prohibited.
